The Visa Box Terms of Use

PLEASE READ THIS TERMS OF USE AGREEMENT CAREFULLY. IT REQUIRES BINDING ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, MEANING YOU WAIVE YOUR RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN ANY CLASS ACTION. PLEASE REVIEW THE GOVERNING LAW AND DISPUTE RESOLUTION SECTION BELOW FOR DETAILS.


1. Acceptance of Terms

This Terms of Use agreement ("Terms" or "Agreement") is a legally binding contract between you ("you" or "User") and The Visa Box, LLC ("The Visa Box," "we," "us," or "our"), a company registered in California, United States at 3435 Wilshire Blvd., Ste. 1035, Los Angeles, CA 90010. These Terms govern your access to and use of The Visa Box website, located at www.thevisabox.com (including all subdomains) (the "Site") and services, including any online platforms, tools, or applications we offer for completing immigration forms (collectively, the "Services"). By accessing or using our Site or Services, you confirm that you are eligible to use the service under applicable laws and agree to be legally bound by these Terms and our Privacy Policy (incorporated herein by reference). Certain The Visa Box Services are also subject to additional terms ("Service-Specific Terms"), which are available here (https://www.thevisabox.com/service-specific-terms/). In the event of a conflict between a term of the applicable Service-Specific Terms and a term of this Terms of Use agreement, the Service-Specific Terms will control. If you purchase Services that include attorney review, your relationship with the attorney will be governed by the Attorney Agreement. If you do not agree to these Terms or the Privacy Policy, you must not access or use the Site or Services.

The Site and Services are intended for individuals 18 years of age or older. By using our Site or Services, you represent that you are at least 18 (or the age of majority in your jurisdiction) and legally capable of entering into this Agreement. If you are under 18, you may not create an account or use The Visa Box Site or Services. (A parent or legal guardian may use the Site or Services on behalf of a minor child solely for the purpose of including the child's information in an application, in which case the adult is fully responsible for the minor's use of the Site or Services.)

We may update or modify these Terms from time to time. We will post the revised Terms with an updated "Last Updated" date. If we make material changes, we may also notify you by email or via the Site or Services. By continuing to use the Site or Services after any changes become effective, you agree to the updated Terms. If you do not agree to the revised Terms, you must stop using the Site or Services.


2. Description of Services; No Affiliation with Government

The Visa Box provides an online platform designed to assist users in preparing certain forms required by U.S. government agencies for immigration, non-immigrant visas, citizenship, and other applications and petitions. Our Services include self-guided tools, translated instructions, and step-by-step form preparation assistance intended to make the completion of such forms less confusing for English speakers and non-English speakers. For example, in addition to English instructions, we offer guidance in languages other than English (currently Korean, and possibly more in the future) to help you understand and complete U.S. Citizenship and Immigration Services ("USCIS") forms.

No Government Affiliation: The Visa Box is a private company and is not affiliated with or endorsed by any government agency, including USCIS or the U.S. Department of State. All USCIS forms are available for free from the U.S. government. You are not required to use our Site and Services to complete immigration forms, and using our platform does not guarantee that your application will be approved by any government agency. We assist with form preparation and provide general information, but we cannot influence or expedite any government decision or process.

No Guarantee of Results: While we strive to provide helpful guidance and accurate translations, we do not guarantee that the forms you prepare using our Services will be error-free or accepted by USCIS. It is your responsibility to review all completed forms for accuracy and completeness. Immigration laws and policies may change, and while we aim to keep our information up to date, we make no warranty that the guidance provided through the Site or Services is always current or applicable to your specific situation. You should always ensure you are using the latest USCIS forms and instructions. If you have any doubts or complex issues, consider seeking professional legal advice (for example, through our premium plan described below or another qualified attorney).

Government regulations, forms, and filing fees are subject to change without notice. In the event that a change in form, fee, or government policy occurs after you have received your completed application materials, The Visa Box will, upon your request, provide updates to your application at no additional cost for a period of up to seven (7) business days from the date of delivery of your application packet. It is your responsibility to stay current with the government regulations, forms, and filing fees, and request for any necessary updates to your application.


3. Not a Law Firm (Basic Plan) vs. Attorney-Assisted Premium Plan

The Visa Box Is Not a Law Firm: The Visa Box is not a law firm and does not provide legal representation or legal advice through its basic self-help Services. NO ATTORNEY-CLIENT RELATIONSHIP is created between you and The Visa Box when you use the Site or the basic (self-guided) Service. Legal advice involves applying the law to your specific situation, which we do not do in the basic plan. Instead, we provide general information and tools for self-guided form completion. The information, translations, and tools we provide in the basic plan are for self-help purposes and general informational use only. They are not a substitute for the advice of a licensed attorney. We do not review your answers for legal accuracy, provide legal opinions, or apply the law to your specific circumstances in the basic service.

Premium Plan - Attorney Services: If you choose to purchase our premium plan (or any Service tier that includes attorney assistance or legal advice), you will have access to a licensed immigration attorney who can review your application, provide legal advice, and guide you through the process. Choosing the premium plan will form an attorney-client relationship between you and the attorney who assists you. In the premium plan, the attorney will either be an independent partner attorney or part of an affiliated law firm working with The Visa Box. You may be required to agree to a separate engagement agreement or attorney-client contract with that attorney or law firm, outlining the scope of legal services and the attorney's responsibilities. The Visa Box will facilitate your communication with the attorney, but any legal advice is provided by the attorney, not by The Visa Box itself. Your relationship with the attorney will be governed by the Attorney Agreement.

No Attorney-Client Relationship in Basic Plan: Unless you are enrolled in the premium attorney-assisted plan (and have formally engaged an attorney), you are solely responsible for your use of the self-guided tools. Any guidance provided by The Visa Box in the basic plan (such as help text, translated explanations, or automated checks) is not personalized legal advice, form preparation, nor language interpretation. Using the Services (other than in the premium plan with an attorney) does not create any confidential or privileged relationship between you and The Visa Box, including, without limitation, an attorney-client relationship, or any responsibility as a preparer or interpreter of the forms you complete using our Services. Please do not send us confidential legal questions unless you are working with an attorney under the premium plan. If you have legal questions that go beyond the scope of our basic service, you should consult with a qualified immigration attorney.

Attorney Independence and No Warranty: Attorneys available through the premium plan are independent professionals licensed to practice law. While The Visa Box may facilitate your connection with an attorney and collect fees on their behalf, the attorney-client relationship is between you and the attorney. The Visa Box does not interfere with or direct the legal advice provided by the attorney. We do not guarantee any specific outcome from legal services. The attorney is solely responsible for the legal counsel provided to you, and The Visa Box is not liable for any acts or omissions of such attorney. However, if you have concerns about your experience with a premium plan attorney, please contact us and we will do our best to address the situation.


4. User Accounts and Security

4.1 Account Registration

To access certain features of the Site and Services (such as saving your progress on an application or using the premium plan), you may need to create an account. When you register an account, you must provide truthful, accurate, and current information about yourself. This may include your name, email address, and other contact information. You agree to keep your account information updated and accurate at all times. You may not impersonate anyone else or provide an email address or other information that you are not authorized to use. The account is for your personal use only, and you may not create multiple accounts for the same person without permission.

4.2 Account Credentials

Upon registration, you will create a username and password (or other secure login method). You are responsible for maintaining the confidentiality of your login credentials. We recommend using a unique password for your account that you do not use for other services to enhance security. Do not share your password or allow others to access your account. You agree to notify us immediately at our support contact (see Contact Us section below) if you suspect any unauthorized access to or use of your account. You are responsible for all activities that occur under your account, whether or not you authorized them. We recommend that you log out after using the Site or Services, especially on a shared device.

4.3 Account Communications

By creating an account, you consent to receive electronic communications from The Visa Box related to your account and use of the Site and Services. This may include transactional messages (e.g. confirmations, receipts, notices about your application status or account changes) as well as promotional messages (e.g. newsletters, special offers), unless prohibited by law. You can opt out of promotional emails at any time by using the unsubscribe link in those emails or contacting us. However, we may still send you important account or service-related announcements (which are not promotional in nature) even if you opt out of marketing emails.

4.4 Account Termination

You may terminate your account at any time by contacting us or using any account deletion function we provide. Please note that we may retain certain information as required by law or as outlined in our Privacy Policy. We also reserve the right to terminate or suspend your account as described in the Termination section of these Terms.

4.5 Application Tracking and Receipt Number

If you purchase a service from us and submit an immigration application through our platform, we may assign a unique email address to your account for the limited purpose of receiving your USCIS receipt number directly from USCIS. By using our Services, you authorize The Visa Box to use this receipt number to periodically check the status of your application and to provide you with general updates or information about next steps in the immigration process. This does not replace your responsibility to monitor your own case or respond to USCIS communications.


5. Acceptable Use of Services

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Site and Services for your personal, lawful, non-commercial use in accordance with these Terms. This license is provided solely for the purpose of allowing you to prepare and manage your own (or your direct family member's) immigration application using our platform. All rights not expressly granted to you are reserved by The Visa Box. You agree not to resell or make commercial use of our Site or Services or content without our written permission.

5.1 Prohibited Conduct

You agree that you will only use the Site and Services as intended and in compliance with all applicable laws and regulations. In using The Visa Box, you specifically agree NOT to:

5.2 User Responsibilities

You are responsible for your own use of the Site and Services and for any content or data you input into the platform. You must ensure that all information you provide is accurate and up-to-date. Inaccurate or outdated information could affect your immigration application or our ability to provide the Services. Providing false, inaccurate, misleading, or deceptive information, or failing to disclose information requested by The Visa Box or required to be included or disclosed on a USCIS or other government form, may lead to the denial of your application by the relevant government agency. The Visa Box shall bear no liability to you for any consequences arising from such actions. Before submitting any application generated through our Service to a government agency, it is your responsibility to review the forms for accuracy and completeness. If you notice errors in a form, you should correct them (you can typically edit answers in our platform before finalizing) or contact us or your attorney (if on the premium plan) for guidance.

We reserve the right (but have no obligation) to monitor use of the Site and Services and to investigate any suspected misuse or violation of these Terms. If we believe you are violating any part of these Terms or are engaging in behavior that could harm us, other users, or third parties, we may warn you, suspend your access, remove problematic content, or terminate your account, at our discretion. The Visa Box will investigate any conduct that may constitute a violation of these Terms and may involve, or cooperate with, law enforcement authorities in the investigation or prosecution of individuals engaged in such conduct.


6. Fees and Payments

6.1 Service Fees

The Visa Box offers its Services on a paid per-form or per-application basis. Certain basic informational content on our site may be free to access, but to use our interactive form-completion tools or to finalize an immigration application using our platform, you will be required to pay a fee ("Service Fee"). We may also offer different service tiers (for example, a basic self-help package versus a premium attorney-assisted package) at different prices. All applicable fees for each form or service will be clearly communicated to you (either listed on our website or presented at the time of checkout). By electing to use a paid Service, you agree to pay the quoted Service Fee. Prices are listed in U.S. Dollars and do not include any taxes or government filing fees unless otherwise stated. We reserve the right to change the pricing for our Services or institute new fees at any time; however, any changes to pricing will not apply retroactively to Services you have already purchased.

Mailing Service; Included Ancillary Fees: In addition to access to our form-preparation tool, The Visa Box will provide a mailing service for submission of your application/petition package to USCIS. Unless otherwise stated at checkout, the Service Fee includes the following ancillary items to be included in your package: (i) a $19.99 basic mailing fee for USPS Certified Mail; (ii) a $15.00 photo printing fee for two U.S. passport-style photos; and (iii) a $45.00 basic translation fee for certain personal documents issued by the Republic of Korea—currently limited to the Basic Certificate (Detailed), Family Relations Certificate (Detailed), and Marriage Certificate (Detailed)—together with a Certificate of Translation. The scope of documents eligible for basic translation may be updated from time to time. Optional upgrades or add-ons may be offered for an additional fee (for example, USPS overnight service for expedited shipping, currently an additional $20, or translation services outside the scope of the basic translation service). These ancillary items are bundled with the Service and are not severable or subject to price reductions; accordingly, if you decline or do not utilize the basic translation service, the Service Fee will not be reduced (including no $45 credit or discount).

6.2 Government Filing Fees

Please note that government filing fees are NOT included in The Visa Box's Service Fees. These fees are set by government agencies and may change without notice. You should verify the current fees with the relevant authorities before submitting your application. U.S. government agencies (such as USCIS or the Department of State) may charge their own fees for submitting visa petitions, application forms, biometric services, or other immigration benefits. You are responsible for ensuring timely and successful payment of all required government filing fees. For paper filings submitted via our mailing service, you will complete and sign the applicable USCIS payment authorization (e.g., Form G-1650, Authorization for ACH Transactions, or Form G-1450, Authorization for Credit Card Transactions) (USCIS publishes official instructions for these forms), or provide a check or money order payable to the appropriate agency, and you authorize us to place that payment instrument on top of your application/petition package for submission to USCIS. The government will process the payment upon receipt; if the payment is declined or rejected, your filing may be rejected, and you remain responsible for any re-filing or additional fees.

The Visa Box's fees cover the use of our platform and, if applicable, access to attorney review in the premium plan; they do not cover government-imposed charges, medical exam costs, or other third-party costs unrelated to the limited ancillary services expressly described in Section 6.1 (e.g., basic mailing, photo printing, and the specified basic translation for certain Korean civil documents). We will inform you of the government fees required for your application as part of our guidance, but paying those fees is your responsibility and outside the scope of our Service Fee.

6.3 Payment Method

When you purchase our Services, you must provide a valid payment method (such as a credit card or other accepted electronic payment). By entering your payment information, you represent and warrant that you are authorized to use the chosen payment method and you authorize The Visa Box (or our designated payment processor) to charge the full amount of the Service Fee to that payment method. All payments must be made in advance or at the time of ordering the Service unless we expressly agree otherwise. If your payment method cannot be charged or is declined, we are not obligated to provide the Service or may suspend provision of the Service. You agree to promptly update your payment information if it changes or if the card expires, so we can complete the transaction.

6.4 Third-Party Payment Processing

We use secure third-party payment processors (for example, credit card processing companies) to handle payment transactions. The Visa Box does not store your full credit card number or bank account details on our systems. Such sensitive financial information is transmitted directly to our payment processor over encrypted connections. Our payment processors are authorized to use your payment information only as needed to process transactions requested by you or us. By making a payment, you also agree to any applicable terms of service or privacy policies of our payment processing partners. If there is an issue with payment processing (for example, a chargeback or error), we reserve the right to delay or cancel your Service until the issue is resolved. You are responsible for any fees or charges imposed by your bank or card issuer (such as foreign transaction fees if you are using the service from outside the U.S.).

6.5 No Refund Policy (and Exceptions)

All Service Fees are generally non-refundable once the Service has been provided.

Change-of-Mind Grace Period (48 Hours): Notwithstanding anything to the contrary in this Section 6.5, if, after purchasing a service product, you elect not to proceed with the Service, you may request a refund by contacting The Visa Box Customer Support at info@thevisabox.com within forty-eight (48) hours of payment. In such case, we will issue a refund of the amount paid less a US $5 third-party transaction fee. After forty-eight (48) hours from payment, no refund will be issued on this basis.

For form preparation services, your payment is deemed earned upon receipt, as substantial guidance is considered to have been provided at that point. If you are on the premium plan and have already consulted with an attorney or had your case reviewed, the fee is likewise earned. However, our goal is customer satisfaction, and if you are unsatisfied with the Service for any reason, please contact us at our support email to discuss the issue. We may, at our sole discretion, offer a remedy such as a correction of any error, a credit toward future services, or a partial/full refund, especially if the Service was not delivered as promised or there was a problem on our end. Any such accommodation will be determined on a case-by-case basis. Nothing in these Terms limits any refund rights that you may have under applicable law (for instance, certain jurisdictions may require refunds in specific circumstances).

Please note that government filing fees that you pay (whether through us, if we facilitate it, or directly to the government) are not refundable by The Visa Box once the application is submitted to the government, even if your application is later denied or if you change your mind, because those fees are determined by the government's policies.

6.6 Premium Plan Fees

If you purchase a premium plan that includes attorney assistance, the fee you pay to The Visa Box will cover both the use of our platform and the attorney's fee for their legal services. The portion of the fee attributable to legal services may be transferred to the attorney or law firm providing the service on your case. You acknowledge that The Visa Box is collecting the fee on behalf of the attorney for convenience, and that once the attorney review or consultation has begun, that portion of the fee may be considered earned by the attorney. (In the event you are entitled to a refund under a satisfaction guarantee or similar policy we may have, we will coordinate with the attorney regarding the refund of the legal fee component as necessary.) More detailed information regarding fees for a premium plan that includes attorney assistance will be available in the Attorney Agreement in the future.


7. Intellectual Property Rights

7.1 Ownership of The Visa Box Materials

All content and materials available through the Site and Services, including but not limited to text, guides, translations, software, graphics, logos, button icons, videos, images, and compilations of data, as well as the design, arrangement, and "look and feel" of the Site and Services, are the intellectual property of The Visa Box or our licensors. This includes the software code that operates the platform and any proprietary algorithms or processes for translating or generating forms. Such materials are protected by copyright, trademark, trade secret, and other intellectual property laws. The Visa Box™ and our associated logos and taglines are trademarks/service marks of The Visa Box, LLC. You are not granted any ownership rights in these intellectual property assets by using our Site or Services.

7.2 License to Use Content

During the term of this Agreement, The Visa Box grants you a limited license to view, download, and print content from our Site and Services solely for your personal, noncommercial use in connection with your immigration application. For example, you may print out form instructions or your completed forms for your own application records. You may not otherwise copy, distribute, publicly display, sell, sublicense, or make derivative works from our content without our prior written consent, except as allowed by law. If we provide sample documents or templates, they are for your personal use only in conjunction with our Services.

7.3 User-Provided Content

In the course of using our Site or Services, you may provide information, answers, documents, or other materials ("User Content"). We do not claim ownership of the personal information or documents you provide; you retain ownership of your own data. However, by submitting content, you grant The Visa Box a limited, non-exclusive, worldwide, royalty-free license to use, reproduce, and process your User Content for the purpose of providing the Services to you and as otherwise described in our Privacy Policy. For example, we may store your answers to populate forms, or share your data with an attorney (if you use the premium service) or with service providers in order to deliver the functionality you requested. We will not use your personal information for other purposes without your permission, except as permitted by our Privacy Policy or required by law.

By providing any User Content, you represent and warrant that you have all necessary rights to that content and that our use of such content in providing the Services will not infringe or violate the rights of any third party or any law. If you submit feedback or suggestions about our Site or Services, we may use those ideas without obligation to you.

7.4 Copyright and DMCA

The Visa Box respects intellectual property rights. If you believe that any content on our site infringes your copyright, you may send us a notice under the Digital Millennium Copyright Act (DMCA). Your notice should include: (a) identification of the copyrighted work you believe is infringed; (b) identification of the content on our site that you claim is infringing (with a URL or screenshot if possible); (c) your contact information (name, address, email, phone); (d) a statement that you have a good-faith belief that the use is not authorized by the copyright owner or the law; (e) a statement under penalty of perjury that your notice is accurate and that you are the copyright owner or authorized to act on their behalf; and (f) your physical or electronic signature. Please send DMCA notices to our designated Copyright Agent at [The Visa Box, LLC - Attn: DMCA Agent, 3435 Wilshire Blvd., Ste. 1035, Los Angeles, CA 90010, USA, email: info@thevisabox.com]. Upon receipt of a valid DMCA notice, we will investigate and, if appropriate, remove the allegedly infringing content. We may notify the user who posted the content (if applicable) and provide them an opportunity to send a counter-notification. It is our policy to terminate accounts of repeat infringers in appropriate circumstances.


8. Privacy and Data Security

Your privacy is very important to us. Our Privacy Policy explains what personal information we collect, how we use and protect it, and your rights regarding your data. We use industry-standard security measures to safeguard your information, but no system is completely secure. By using the Site and/or Services, you agree to the collection, use, and sharing of your information as described in the Privacy Policy. In particular, you acknowledge and agree that in order to provide the Services (for example, to fill out forms, or to connect you with an attorney in the premium plan), The Visa Box may need to collect sensitive personal information from you (such as your immigration history, social security number, etc.) and store that information on our servers, which are primarily located in the United States. We implement security measures to protect your data (see Privacy Policy for details), but we cannot guarantee absolute security. By using the Site or Services, you consent to this handling and storage of data. If you do not agree, please do not use the Site or Services. If you use the premium plan, you also consent to our sharing of your relevant personal information with the attorney or law firm that will be assisting you, under strict confidentiality, so that they can provide legal services. All personal data sharing with third parties (like payment processors, attorneys, or cloud hosting providers) is done consistent with our Privacy Policy and for the purpose of delivering or improving the Site and Services.


9. Third-Party Services and Links

9.1 Third-Party Services

The Visa Box may rely on third-party services and providers to operate our platform and deliver certain features. For example, we may use cloud hosting providers (such as Amazon Web Services) to store data, payment processors to handle transactions, and email/SMS services to send verification codes or notifications. We may also from time to time integrate tools or APIs (Application Programming Interfaces) from third parties, such as translation services or mapping services, to enhance our offerings. While we select our partners carefully and aim to ensure they have appropriate security and privacy practices, we do not have direct control over the operations of third-party providers. Therefore, you acknowledge that The Visa Box is not liable for the acts or omissions of third parties in processing your data or providing services, except as required by law. Without limiting the foregoing, The Visa Box is not a lawyer referral service and makes no representations or warranties concerning any law firm or attorney referenced through the Site or Services, including, without limitation, as to whether any such law firm or attorney is duly licensed, qualified, competent, or otherwise capable of providing legal advice appropriate to your specific legal matters. However, if you encounter an issue with a third-party component of our Site or Services, we encourage you to inform us, and we will try to address it or assist you in contacting the responsible provider if appropriate.

9.2 Links to External Sites

Our website or communications may contain links to third-party websites or resources that are not owned or controlled by The Visa Box. For example, we might link to official government websites (like uscis.gov) for reference, or to partner or informational sites. These links are provided for your convenience only. The Visa Box does not endorse and is not responsible for any third-party content, services, products, or information. If you click on a third-party link, you will be directed to that third party's site, and your use of that site will be subject to the third party's own terms and policies (not ours). We strongly encourage you to review the terms of use and privacy policy of any third-party site you visit. The Visa Box shall not be liable for any loss or damage that may arise from your use of any third-party websites or resources.


10. Disclaimer of Warranties

THE VISA BOX SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. To the maximum extent permitted by law, The Visa Box disclaims all warranties of any kind, whether express, implied, or statutory, regarding our Site, Services and content. This includes, but is not limited to, any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not guarantee that the Services will meet your requirements or that outcomes (such as obtaining a visa or immigration benefit) will be achieved. For complex immigration issues, we recommend consulting a qualified attorney.

In particular, The Visa Box makes no representation or warranty that: (a) the Site or Services will be uninterrupted, timely, secure, or error-free; (b) the information or results obtained from the use of the Site or Services (including guidance, translations, or completed forms) will be accurate, complete, or reliable; or (c) any errors or defects in the Site or Services will be corrected. While we strive for accuracy, immigration rules and forms change frequently, and we do not warrant that our guidance reflects the latest legal developments at all times. You assume full responsibility for reviewing your application and ensuring its accuracy and completeness before submission.

No Guarantee of Approval: You understand that using The Visa Box is not a guarantee that your immigration application will be approved by the U.S. government or any other authority. Decisions on immigration benefits are made by government agencies based on their own criteria. The Visa Box has no control over, and assumes no responsibility for, the outcome of your application.

No Legal Advice Warranty (Basic Plan): As stated, in the basic plan The Visa Box is not providing legal advice. Any general information, FAQs, sample documents, or responses from our support team do not constitute specific legal advice and we do not warrant that following such information will ensure any particular result. If you need legal advice tailored to your situation, you should consult an attorney (for example, through our premium service or independently).

Translation and Data Accuracy: While we employ measures to transfer your input into official forms accurately, we do not warrant the accuracy of any transcription of your data. Automated translations or software-driven processes may occasionally err. You should review all translated content and completed forms carefully. The Visa Box does not act as a preparer or interpreter of the forms you generate through our Services. The Visa Box is not liable for consequences of mistakes or omissions that arise from inaccurate translations or data you provided incorrectly.

Downloading and Tech Use: You access and download any material through our Site or Services at your own discretion and risk. You are responsible for any damage to your computer system or loss of data that results from the download or use of any material obtained via the Site or Services. We do not warrant that the Site or emails sent from us are free of viruses or other harmful components.

Some jurisdictions do not allow the exclusion of certain warranties. If applicable law requires warranties despite these Terms, any such warranties are limited to the shortest duration and scope allowed by law. The foregoing disclaimer of warranties does not apply to the extent prohibited by law, including for consumers in North Carolina.


11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE VISA BOX, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER. This includes, without limitation, damages for lost profits or revenues, loss of data, loss of opportunity, costs of substitute services, or any similar damages, whether or not The Visa Box was advised of the possibility of such damages.

In particular, The Visa Box will not be liable for any loss or damage that results from: (a) your use of or reliance on the Site, Services or content (for example, any errors in your application or delays in submission); (b) unauthorized access to or alteration of your transmissions or data; (c) the actions or decisions of any government agency or third party in connection with your immigration application (e.g., any outcome of your immigration application, denial of a visa, delays, or lost documents in mail); (d) any professional services provided by an independent attorney in the premium plan (the attorney bears responsibility for their advice); or (e) any other matter relating to the Site or Services.

Cap on Liability: To the extent that any liability of The Visa Box is not legally excludable, in no event shall the total cumulative liability of The Visa Box and its affiliates to you for all claims arising out of relating to the use of or inability to use the Site or Services or otherwise under these Terms exceed the total amount of Service Fees that you paid to The Visa Box in the six (6) months immediately preceding the event giving rise to such liability. If you have not paid any Service Fees (for example, if you only used free content), The Visa Box's total liability shall not exceed US $50.00.

Exceptions: Some jurisdictions do not allow the exclusion or limitation of certain damages. If laws in your jurisdiction prohibit the exclusion of certain warranties or the limitation of certain liabilities, those portions of the above disclaimers and limitations may not apply to you. In such cases, the scope and duration of our warranties and the extent of our liability will be the minimum permitted under such applicable law. The foregoing limitation of liability does not apply to the extent prohibited by law, including for consumers in North Carolina.

Basis of the Bargain: You acknowledge that The Visa Box has set its fees and entered into this Agreement in reliance upon the disclaimers of warranty and the limitations of liability set forth herein, which reflect an allocation of risk between the parties and form an essential basis of the bargain between us. You agree that these disclaimers and limitations will apply even if any limited remedy fails of its essential purpose.


12. Indemnification

You agree to defend, indemnify, and hold harmless The Visa Box, its parent company (if any), affiliates, and their respective directors, officers, employees, contractors, attorneys, agents, and partners from and against any and all claims, suits, proceedings, disputes, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) that arise out of or relate to: (a) your use or misuse of the Site or Services; (b) your violation of these Terms or any policy referenced herein; (c) your violation of any applicable law or regulation (including immigration laws) or any rights of a third party; or (d) any content or data you submit or transmit through the Site or Services (including any allegations that such content infringes or misappropriates the intellectual property or privacy rights of a third party, or that information you provided was false or misleading).

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (without limiting your indemnification obligations with respect to that matter). In that case, you agree to cooperate with our defense of such claim. You may not settle any claim that implicates or imposes any liability or obligation on The Visa Box without our prior written consent.


13. Termination of Services

13.1 Termination by You

You may stop using the Site or Services at any time. You may also terminate this Agreement by closing your account (if you have one) and discontinuing all use of the Site or Services. To formally terminate and request deletion of your account/data, you may contact us at our support email with your request (see Contact Us section). Termination will not entitle you to any refund of fees already paid, except in cases where you are terminating due to a material, uncured breach of these Terms by us or as otherwise explicitly provided for under a refund policy or guarantee applicable to your purchase (if any). In such exceptional cases, we will assess refunds as appropriate.

13.2 Termination or Suspension by The Visa Box

We reserve the right to suspend or terminate your access to the Site or Services (or any portion thereof), or terminate this Agreement in its entirety, at our sole discretion, at any time with or without notice and with or without cause. Without limiting the foregoing, we may immediately suspend or terminate your account and access if: (a) you breach any provision of these Terms or our Privacy Policy; (b) we cannot verify or authenticate any information you provide to us and you do not promptly provide proof of its accuracy upon request; (c) we believe that your actions may cause legal liability for you, other users, or The Visa Box; or (d) we decide to discontinue the Site, Services or any part thereof. In the event we terminate for cause due to your breach, you will not be entitled to any refunds of fees paid. If we terminate without cause (for example, if we cease providing the Site or Services entirely), we may provide pro-rata refunds for any Services that were paid for but not delivered, as required by law.

13.3 Effects of Termination

Upon any termination of this Agreement for any reason:

The termination of this Agreement will not affect any liability or obligation you may have incurred prior to termination, including any obligation to pay fees or indemnify, nor will it affect any rights or remedies which either party may have accrued up to the date of termination.


14. Governing Law

These Terms and any dispute arising out of or relating to the Site, Services or this Agreement will be governed by and construed in accordance with the laws of the State of California, USA, and, to the extent applicable, the federal laws of the United States. This governing law applies without regard to conflicts of law principles, provided that the Federal Arbitration Act (9 U.S.C. §§ 1-16) will govern the interpretation and enforcement of the arbitration agreement in Section 15 (Dispute Resolution), because the Services involve interstate commerce. Users from other jurisdictions should be aware that their local laws may provide additional rights or restrictions.

If for any reason a dispute is found not subject to the arbitration agreement in Section 15, then you agree to submit to the personal jurisdiction of the state and federal courts located in Los Angeles County, California for resolution of that dispute. You waive any objections to venue or inconvenient forum in such courts. Notwithstanding the foregoing, we acknowledge that you may have rights under consumer protection laws of your state or country of residence that cannot be waived by this Agreement, and nothing in this section is intended to limit any such non-waivable rights.


15. Dispute Resolution and Arbitration Agreement

Please read this section carefully. It requires you to arbitrate disputes and claims with The Visa Box and limits the ways you can seek relief from us. This arbitration agreement survives the termination of this Agreement.

15.1 Good-Faith Resolution

We value our relationship with users and want to address your concerns without the need for a formal dispute. Before initiating arbitration or any legal proceeding, please contact our Customer Support at info@thevisabox.com to discuss your issue. Most user concerns can be resolved quickly and to the user's satisfaction through our support team. If we are unable to resolve your issue within a reasonable time, you may proceed as outlined below.

15.2 Agreement to Arbitrate

You and The Visa Box agree that all disputes, controversies, or claims arising out of or relating to these Terms, the Site, the Services, or any aspect of your relationship with The Visa Box (whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory), shall be resolved through final and binding arbitration on an individual basis, except as expressly provided below. This means that you and The Visa Box are each waiving the right to a trial by jury or to participate in a class action lawsuit. This arbitration agreement is intended to be broadly interpreted and to encompass all disputes or claims between us that can legally be arbitrated, including those arising before you accepted these Terms (such as claims related to statements we made about our Site or Services).

15.3 Exceptions to Arbitration

Despite the terms of 15.2, the following types of disputes will not be subject to arbitration: (a) Small Claims: Either you or The Visa Box may choose to pursue resolution in a U.S. state small claims court (e.g., for disputes or claims within the dollar limit of small claims court jurisdiction) so long as the claim remains in that court and is on an individual (non-class) basis; (b) Intellectual Property: Any dispute relating to the enforcement or validity of your, our, or our licensors' intellectual property rights (such as trademarks, trade dress, copyrights, or patents) may be decided only by a court of competent jurisdiction, and not by an arbitrator; and (c) Injunctive Relief: Either party may seek injunctive or equitable relief in a court to prevent actual or threatened infringement, misappropriation, or violation of a party's data security, intellectual property rights, or other proprietary rights. In addition, nothing in this arbitration agreement prevents you from bringing issues to the attention of federal, state, or local agencies, which can, if the law allows, seek relief against us on your behalf.

15.4 Arbitration Procedures

The arbitration will be administered by a neutral alternative dispute resolution ("ADR") provider mutually agreed upon by you and The Visa Box. If we cannot agree on an ADR provider, the arbitration will be administered by JAMS, Inc. (or if JAMS is unavailable, by the American Arbitration Association), and conducted under the JAMS Streamlined Arbitration Rules & Procedures (if the dispute involves claims and counterclaims under $250,000) or the JAMS Comprehensive Arbitration Rules & Procedures (if over $250,000) in effect at the time the arbitration is initiated, except as modified by this Section. You can find JAMS's rules on their website. If JAMS is unwilling or unable to serve, we or the court shall select another reputable arbitration provider.

To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to our registered agent or to an address we designate. (Please see the Contact Us section for our mailing address; if none is specified for legal notices, you can request the appropriate address by contacting info@thevisabox.com.) The arbitration shall be conducted by a single, neutral arbitrator. You may choose to have the arbitration conducted by telephone, based on written submissions, virtually, or in-person in Los Angeles County, California, or at another mutually agreed location. If an in-person hearing is required, you and we will confer in good faith to agree on a location; if we cannot agree and you are an individual consumer, the arbitrator will typically choose a location convenient for you.

The arbitrator shall apply the same substantive law as a court in California would apply (subject to preemption by federal law, including the Federal Arbitration Act), and may award the same damages and relief as a court (including attorneys' fees if allowed by law). The arbitrator will provide a reasoned written decision if requested by either party. Judgment on the arbitration award may be entered in any court having jurisdiction.

15.5 Arbitration Fees

Payment of all filing, administration and arbitrator fees will be governed by the rules of the arbitration provider (for example, JAMS's rules). If you are an individual consumer and the law of your jurisdiction requires us to cover certain arbitration fees (e.g., filing fees or arbitrator compensation) for this arbitration agreement to be enforceable, then we will do so to the extent required. Otherwise, each party is responsible for their own attorneys' fees and costs unless the arbitrator awards otherwise under applicable law.

15.6 No Class Actions

You and The Visa Box agree that arbitration will take place only on an individual basis. Neither you nor The Visa Box will have the right to join or consolidate claims in arbitration by or against other individuals or entities, or to bring or participate in any class action or representative proceeding (including as a private attorney general) against the other. The arbitrator shall have no authority to hear or arbitrate any class or collective action or to award relief to anyone but the individual party to the arbitration. If this class action waiver is found unenforceable, then the entirety of the arbitration agreement (except for this sentence) shall be null and void, but the rest of the Agreement will still apply.

15.7 Opt-Out Right

We believe the arbitration agreement in this Section 15 is beneficial for both parties, but if you do not wish to be bound by arbitration and class-action waiver, you have the right to opt out. You may opt out of this arbitration agreement by sending a written notice of your decision to opt out to the following email: atty@thevisabox.com, within 30 days of first accepting these Terms. The opt-out notice must clearly state that you wish to opt out of the arbitration agreement and must include your name, address, the email associated with your account (if any), and your signature (if sent by physical mail, a signature is required; if by email, a typed name will suffice as a signature). If you opt out of arbitration, neither you nor The Visa Box will be bound by the arbitration provisions of this Agreement. Opting out of this arbitration agreement will not affect any other part of these Terms, including the provisions regarding governing law or courts that apply in the event the arbitration agreement is eventually found unenforceable or if you opt out.

15.8 Severability of Arbitration Provisions

Except as provided in the class action waiver clause above, if any part of this Section 15 is found to be invalid or unenforceable, the remaining portions shall remain in force. In the event that the entirety of this arbitration agreement is found to be unenforceable for any reason, or if you opt out as described above, then, and only then, the disputes or claims described in 15.2 shall be decided exclusively by a court of competent jurisdiction in Los Angeles, California, and you and The Visa Box agree to submit to the personal jurisdiction of that court.


16. Changes to the Services or Terms

We are constantly improving and updating our Site and Services. The Visa Box reserves the right to change, suspend, or discontinue any aspect of the Site or Services at any time, including the availability of any feature, database, or content, with or without notice and without liability to you. We may also impose limits on certain features or restrict your access to parts or all of the Site and Services without notice or liability.

Similarly, we may modify these Terms from time to time as explained at the beginning of this document. When we make changes, we will update the "Last Updated" date at the top of the Terms and post the new version on our website. In some cases, we may notify you of changes via email or through the Site or Service (especially if there are significant changes). It is your responsibility to review these Terms periodically. Your continued use of the Site and/or Services after the effective date of any updated Terms will constitute your acceptance of those changes. If you do not agree to a change, you must stop using the Site and/or Services and, if applicable, terminate your account.


17. Miscellaneous Provisions

17.1 Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or additional terms and conditions provided to you within the Site or Services (for example, if you use a premium plan, you may also be subject to an attorney-client agreement), including the Service-Specific Terms where applicable, constitute the entire agreement between you and The Visa Box concerning the Site and Services. They supersede all prior and contemporaneous understandings, agreements, representations, or warranties, both written and oral, regarding the Site and/or Services.

17.2 Amendments

Except as stated in the section regarding updates to these Terms, any amendment or waiver of this Agreement by you must be in writing and signed by an authorized representative of The Visa Box.

17.3 No Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by The Visa Box.

17.4 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, unless such modification is not permitted by law, in which case the provision shall be severed from these Terms.

17.5 Assignment

You may not assign or transfer these Terms (or any of your rights or obligations hereunder) without our prior written consent. Any attempt to assign without consent will be null and void. The Visa Box may freely assign or transfer this Agreement (in whole or in part) as part of a merger, acquisition, sale of business or assets, or by operation of law or otherwise. These Terms shall bind and inure to the benefit of the parties and their respective successors and permitted assigns.

17.6 Relationship of the Parties

You and The Visa Box are independent contracting parties. These Terms do not create a partnership, franchise, joint venture, agency, fiduciary, or employment relationship between the parties. You are not an agent or representative of The Visa Box, and you shall not have any authority to bind The Visa Box to any obligation.

17.7 No Third-Party Beneficiaries

Except as expressly provided in these Terms (for example, the indemnified parties under the Indemnification section, or any released parties under specific provisions) and except for the attorney providing services in the premium plan (who will have the benefit of relevant disclaimers or liability limitations regarding The Visa Box's role), there are no third-party beneficiaries to this Agreement. This means no other person or entity has rights under these Terms, except you and The Visa Box (and our successors/assigns).

17.8 Force Majeure

The Visa Box shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, such as natural disasters, acts of government, war, terrorism, riots, labor disputes, internet or power outages, pandemic or epidemic events, or any other force majeure event.

17.9 Export Compliance

You agree to comply with all applicable export control and trade sanctions laws. You shall not - directly or indirectly - export, re-export, provide, or otherwise transfer any part of our Site or Services to any individual, entity, or country prohibited by U.S. export laws or any other applicable jurisdiction. You represent that you are not located in, under the control of, or a national or resident of any country to which export of the Site or Services would be prohibited by applicable law.

17.10 Headings and Interpretation

Section headings in these Terms are for convenience of reference only and shall not affect the interpretation of any provision. Terms such as "including" are to be construed without limitation. Any ambiguity in these Terms shall not be construed against the drafter (you and The Visa Box agree that each party has had the opportunity to review and negotiate these Terms, and no presumption or burden of proof shall arise favoring or disfavoring either party by virtue of authorship of these Terms).

17.11 Promotions; Offers (General)

From time to time, The Visa Box may make available promotions, discounts, coupons, credits, referral programs, introductory pricing, or other offers (collectively, "Promotions"). Promotions are offered at our discretion and may be modified, suspended, or terminated at any time.

(a) No Incentives for Reviews/Testimonials. The Visa Box does not offer compensation, gift cards, or other incentives in exchange for customer reviews or testimonials. Reviews should be honest, voluntary, and uncompensated.

(b) Eligibility; Limits. Unless expressly stated otherwise in the Promotion, Promotions are void where prohibited and may be limited to U.S. residents, age 18+, one per person/household/account, and subject to identity and eligibility verification. Promotions are not available to employees, contractors, or affiliates of The Visa Box where restricted by law.

(c) Exclusions; Non-severable Charges. Unless expressly stated in the Promotion terms, Promotions do not apply to (i) government filing fees or other government-imposed charges; (ii) third-party costs (e.g., medical exams) outside the limited ancillary services described in Section 6.1; or (iii) amounts already discounted or credited. Promotions are not redeemable for cash, are non-transferable, and may not be combined with other offers.

(d) Promo Codes; Credits; Expiration. Promotional codes and credits have no cash value, may be single-use, and expire on the date stated (or, if none is stated, 30 days from issuance). Lost, stolen, or misdirected codes will not be replaced. We may reverse or refuse a Promotion in cases of error, fraud, abuse, or violation of these Terms.

(e) Official Rules; Conflicts. Certain Promotions (e.g., sweepstakes or contests) may be governed by separate Official Rules. If there is a conflict between the Official Rules and these Terms, the Official Rules control for that Promotion. Where required by law, such Promotions will include "no purchase necessary" and other legally required disclosures.

(f) Taxes and Reporting. You are responsible for any taxes that may apply to a Promotion benefit. Where required by law, you agree to provide tax documentation (e.g., a Form W-9) and acknowledge that we may report the value of Promotion benefits to tax authorities.

(g) Third-Party Offers. If a Promotion involves a third-party product or service, that third party's terms apply to redemption and use. The Visa Box is not responsible for third-party availability, fulfillment, or policies.
